General Equipment Usage

The Red River Ski & Summer Area embraces and practices the policies and principles reflected in the United States Department of Agriculture/Forest Service Accessibility Guidebook for Ski Areas Operating on Public Lands. When operated in accordance with the rules and regulations of the Red River Ski & Summer Area, ski equipment is allowed, with the exception of snow skates, cross country skis, and snowshoes. A person who has a disability is allowed to utilize any specialized equipment that has been designed and manufactured solely for use by individuals who have disabilities, for example, adaptive equipment including snow monoskis, biskis, outriggers, and sitskis That use is in accordance with the American with Disabilities Act (ADA) Section 36.302(b)(2)(A)(ii) which requires reasonable modifications in rules, practices, or procedures, unless the entity can demonstrate that making such modifications would fundamentally alter the program. The Red River Ski & Summer Area offers or will arrange for any adaptive equipment that meets this definition when requested in advance by individuals wanting to enjoy sports at the Red River Ski & Summer Area. Although not manufactured as an adaptive device, ski bikes are allowed on a trial basis during the winter season.
Power-Driven Devices
The RRSA has determined that the use of any power-driven devices or vehicles by the public, including other power-driven mobility devices used by individuals with mobility disabilities, would conflict with the Red River Ski & Summer Area's safety requirements necessary for the reasonably safe operation of our on-slope activities. These safety concerns include the use of devices on the slopes that expose the user and skiers/snowboarders to a safety hazard; collisions with downhill skiers and snowboarders; and the use of devices that may provide access into closed areas that pose avalanche hazards. These safety requirements are based on actual risks and are not intended to be discriminatory in any way.
Acknowledgment of Risk
By using a Red River Ski & Summer Area lift ticket, the customer is entering into the following agreement, which is clearly printed on the reverse of each lift ticket. “I understand skiing and other related outdoor snow activities are inherently hazardous and agree to be bound by the New Mexico Ski Safety Act in Taos County and Red River Ordinances. I understand there are risks in skiing that are impossible to eliminate. I am responsible for my own safety while skiing. I agree to assume all risks of injury and not sue. By use, I agree that any claim arising from the use of this ticket is governed by the laws of the State Of New Mexico and exclusive jurisdiction thereof will be in the state or federal courts of New Mexico. This ticket remains the property of Red River Ski & Summer Area and shall be surrendered upon demand of cause without refund or rebate.”
